L’ article a pour objet la pratique de la Cour européenne des droits de l’Homme consistant à faire référence à des « sources externes » aux fins d’interpréter et d’appliquer la Convention. Cette pratique est riche en défis autant qu’en opportunités au regard du principe de sécurité juridique.
The article discusses the use of ‘external sources’ by the European Court of Human Rights to interpret and apply the European Convention on Human Rights. This practice carries both opportunities and challenges in light of legal certainty.
