Ivana Isailovic analyzes two recent ECtHR decisions on the regulation of transnational surrogacy agreements. She argues that the rulings confirm the need for an interdisciplinary perspective in the study of the regulation of transnational households, and that the Court’s arguments, while recognizing parental ties in non-traditional families, could produce unintended effects that might marginalize these households.
